A woman named Soledad Félix has filed complaints with the Juárez City Human Rights Commission after discovering that a photo of her in hospital is now being used by various tobacco companies as a warning against smoking.

Her family claim the photo was taken when she was in the ICU following a heart attack 4 and a half years ago, but they are unsure of who took the picture. “We do not know who took that picture when my mother was hospitalized after suffering a heart attack, because we never authorize anyone to take pictures,” the woman’s daughter said.

Even though the photo has been used by tobacco companies around the world such as Fortuna and Marlboro, it’s the Ministry of Health that will be suffering — they’re the ones that acquire and issue these images.

The filed complaints could turn into some more serious lawsuits that cite everything from invasion of privacy to moral damages.
